The use of a mobile phone at work typically comes under question when used in conjunction with other work equipment e.g. company owned vehicles, vans, cars.
It is an offence under the Road Vehicles (Construction & Use) (Amendment) (No.4) Regulations to drive a motor vehicle (company or privately owned) on the public highway if the driver is using a hand held telephone or similar device.
Even with hand free phones there is still the increased risk of accident. There could be serious consequences for employers who provide such equipment to their employees and require them during the working day to keep in contact with them, as this may be done whilst the vehicle is being driven when a call is made / received. The mobile phone / car policy must be explicit in its wording.
